Lawyer Discharged,Acquited Of N50 Million Domino Property Fraud
A
Lagos High Court, Ikeja on Wednesday discharged and acquitted a lawyer, Yetunde
Sousa accused of N50million property fraud.
In
her Judgment, Justice Raliat Adebiyi held that the prosecution failed to prove
its case against Sousa and others beyond reasonable doubt.
The
Lagos State Government had filed a one-count charge of alleged fraud against
Yetunde Sousa.
The
lawyer was alleged to have defrauded Domino Stores Limited and Ozone Cinemas of
the said sum.
The
state alleged that the money was given to her by Micheal Murray Bruce as a
renewal of lease of a property situated at Harbour Road, Apapa.
The
offence was said to be contrary to section 390(9) of the Criminal Code Laws Cap
C17, Vol. 2 of Lagos State 2003.
During
trial, the state presented three witnesses to prove the allegations against the
defendant
The
defendant and two other witnesses testified to prove her innocence of the crime
she was alleged to have committed.
In
her judgement, Justice Adebiyi held that the state failed to establish a prima
facie against the defendant as there was no nexus linking the defendant with
the fraud allegations.
The
judge held that the defendant only acted in her professional capacity in the
lease of the property in question.
